    LA POLÍTICA DE PREVENCIÓN DEL DAÑO ANTIJURÍDICO EN LOS MUNICIPIOS MÁS DEMANDADOS DE SEXTA CATEGORÍA DEL DEPARTAMENTO DEL TOLIMA

    El presente documento de reflexión titulado como “La política de prevención del daño antijurídico en los municipios más demandados de sexta categoría del Departamento del Tolima” se abordará desde diferentes momentos, sobre los cuales se detallan elementos importantes los cuales dan cuenta sobre los antecedentes que posibilitaron la existencia de una Política de Prevención del Daño Antijurídico, la necesidad de incorporarla como un instrumento dentro de las herramientas a disposición de la buena Administración Pública y los preceptos de buen gobierno, gobernanza y gobernabilidad; el contenido sustancial de las mencionadas políticas de prevención del daño antijurídico, el papel de la Agencia Nacional de Defensa Jurídica del Estado colombiano como institución sobre la cual recae principalmente la función de prevenir el daño antijurídico y representación judicial del Estado, para finalmente presentar un panorama concreto sobre la actividad litigiosa y su impacto en los municipios de sexta categoría más demandados del Departamento del Tolima y las implicaciones que el daño antijurídico trae para con ellos, iniciando con las diferentes medidas contempladas para mitigar un asunto tan importante desde los puntos de vista jurídico, político, administrativo público, social y presupuestal, que permitan integrar modelos eficientes de proceder estatal, correspondiendo a la labor de protección patrimonial en todos los escenarios, en este caso específico, en el escenario ex ante.The present reflection paper entitled as “The impact of the policy of prevention of the antijuridical damage in the administrations of the most sued municipalities of sixth category of the department of Tolima” will be approached from different moments, on which are detailed important elements that give account on the background that made possible the existence of a Policy of 9 Prevention of the Antijuridical Damage, the need to incorporate it as an instrument within the tools available to the good Public Administration and the precepts of good government, governance and governability; the substantial content of the aforementioned policies for the prevention of antijuridical damages, the role of the National Agency for the Legal Defense of the Colombian State as the institution on which falls mainly the function of preventing antijuridical damages and judicial representation of the State, to finally present a concrete overview of the litigation activity and its impact on the most sued sixth category municipalities of the Department of Tolima and the implications that antijuridical damages bring to them, starting with the different measures they have taken to mitigate such an important issue from the legal, political, public administrative, social and budgetary points of view, which allow the integration of efficient models of state procedure, corresponding to the work of patrimonial protection in all scenarios, in this case specific, in the ex-ante scenario.
